Although Antifa operates as a decentralized movement rather than a formal organization, the Trump administration has criminalized it at the federal level. Consequently, identifying as an anti-fascist now carries the risk of imprisonment.
During a July 4th demonstration outside an Alvarado, Texas, ICE facility, eleven demonstrators—including everyday citizens like a UPS employee and a middle school teacher—gathered to make noise, set off fireworks, and vandalize vehicles with spray paint.
The situation escalated when an individual named Benjamin Song shot and injured a local police officer from a nearby wooded area. Song was appropriately found guilty of attempted murder—a severe and well-established criminal offense that is already clearly defined in the law.
However, federal authorities expanded their scope significantly. They indicted 19 individuals, tagging them as a “North Texas antifa terror cell,” despite eight of the accused not even being present at the protest.
Nine of these individuals were convicted of supplying “material support to terrorists.” For instance, Daniel Sanchez Estrada, a legal permanent resident, is facing up to 40 years behind bars merely for transporting a box of non-Antifa anarchist magazines between his parents’ house and his own.
As highlighted in a recent extensive article by Eric Alterman for The New Republic, “domestic terrorism” is not an actual, codified crime in the U.S. Code. It is a legal classification entirely fabricated by Trump.
Following the death of Charlie Kirk in September, the President issued an executive order within twelve days that officially labeled “antifa” as a domestic terror group. Shortly after, National Security Presidential Memorandum 7 was released, claiming that nearly all politically motivated violence occurring in his second term fit into a broader Antifa conspiracy.
